Abstract

This study highlighted the urgency of strengthening democratic governance in the DRC by fighting for the establishment of the supra-constitutionality and guaranteeing respect for the Constitution and democratic principles. This requires the instituting of effective control and sanction mechanisms, as well as the involvement of national and international actors to support this process. Through the qualitative and quantitative methods, which were supported by the literature review, semi-structured interviews and other comparative analyses, the context of this study was part of a complex legal and political framework, marked by institutional challenges and of the tensions between constitutional norms and governance practices. This study, first of all, shed light on the concept of supra-constitutionality in the Democratic Republic of Congo and its impact on democratic governance. It stressed the importance of strengthening these mechanisms to guarantee respect of the Constitution and the laws in force.
